Please read these Terms & Conditions carefully before renting a vehicle from Exact Car Rental. By entering into a rental agreement with Exact Car Rental, the Renter agrees to these Terms & Conditions.
In these Terms & Conditions, the following definitions apply:
Vehicle: The vehicle or other object that is part of the rental agreement.
Renter: The natural person or legal entity entering into the rental agreement.
Lessor (Exact Car Rental): The party that makes the vehicle available.
Rental Fee: The total amount owed by the Renter, including additional services and administrative costs.
Driver: The Renter or an authorized person operating the vehicle.
Damage: All direct and indirect financial loss suffered by the Lessor, including:
- Damage to or loss of the Vehicle, its parts or accessories, including repair and replacement costs and loss of rental income.
- Damage to persons or property caused with the Vehicle.
- Costs such as fines or penalties imposed on the Driver or Lessor.
1. Rental Price and Period
The rental applies for the agreed period and at the established rate. Return outside opening hours is only possible with prior consent.
The Renter remains liable until the Vehicle has been received and inspected by the Lessor.
2. Extension and Late Return
Extensions must be agreed upon in advance. In the event of a late return of one hour or more, a full additional day will be charged. Parts of days count as full days.
No refund will be given for early return.
3. Exceeding the Rental Period
If the Vehicle is not returned on time, the Lessor may repossess it. All obligations under the rental agreement remain in force until the Vehicle is returned.
All recovery costs are borne by the Renter.
4. Cancellation
Cancellation is free of charge up to 48 hours in advance. In the event of a no-show, 50% of the Rental Fee may be charged.
Any refunds will be processed within 5–10 working days via the original payment method.
5. Payment and Deposit
Advance payment and a deposit may be required. Payment is made at the start of the rental period, unless otherwise agreed.
The deposit is refunded after inspection of the Vehicle and may be offset against any outstanding costs.
6. Costs During Use
The Renter is responsible for fuel, tolls, parking, and cleaning costs.
7. Use of the Vehicle
The Vehicle must be used properly and for its intended purpose.
- Only authorized Drivers may operate the Vehicle.
- The Renter remains fully liable.
- A valid driver’s license is required, and the minimum age is 21 years.
- Subletting is not permitted without the Lessor’s consent.
- The Renter shall not drive or park in prohibited or unsafe areas, such as dark or deserted streets.
- The Renter must comply with all traffic laws at all times and is responsible for any fines resulting from violations.
- The Vehicle may not leave Curaçao.
- Overloading is prohibited.
- Oil levels and tire pressure must be maintained.
- Use of incorrect fuel is prohibited, and all resulting costs are entirely at the Renter’s expense.
- The Vehicle may not be used if it is unsafe to operate.
In the event of damage or an incident, the Renter must immediately:
- Inform the Lessor.
- Contact Curaçao Forensys at 9233 or +5999 461-3282.
- Provide all relevant information.
- Not admit liability.
- Take reasonable steps to prevent further damage.
- Fully cooperate with all required procedures.
8. Liability for Damage
In the event of fault, the Renter is fully liable for all damage and consequential loss. Damage to third parties is generally covered by insurance, except in cases involving:
- Violation of Article 7.
- Use on unsuitable terrain.
- Intent or gross negligence.
- Subletting.
- Uninsured liability.
- Loss of the Vehicle, keys, or documents.
- Transport of hazardous substances.
In these cases, full liability applies.
The deposit/excess is always retained.
Loss of rental income is calculated as:
repair days × daily rate minus 10%.
9. Seizure
In the event of seizure, payment obligations continue until the Vehicle is released and returned. All related costs are borne by the Renter.
10. Liability for Third Parties
The Renter is liable for damage caused by Drivers, passengers, or other users, even if such persons operated or used the Vehicle without permission.
11. Force Majeure
In the event of force majeure, the Lessor may suspend or terminate the agreement without liability. Any applicable refund will be made on a pro rata basis.
Force majeure includes, but is not limited to, strikes, fire, war, epidemics, natural disasters, and government measures.
12. Limitation of Liability of the Lessor
The Lessor’s liability is limited to the amount paid out by the applicable insurance.
13. Personal Data
Personal data is used for the execution of the rental agreement and the provision of services. The Renter may object to the use of personal data for direct marketing purposes.
14. Track & Trace
Vehicles may be equipped with GPS tracking systems, alarm systems, and immobilizers.
15. Applicable Law
The agreement is governed by the law of the Netherlands Antilles. Disputes will be handled by the Court of First Instance in Curaçao.
16. Additional Provisions
These Terms & Conditions also apply to supplementary agreements.
